Employment Practices Liability

Even when employment practices lawsuits aren't making headlines, they are creating a negative impact on the financial well being and the reputation of organizations nationwide. Lawsuits alleging discrimination, wrongful termination, sexual harassment, or a violation of multiple federal, state and local statutes continue to grow in both frequency and severity.

In a seemingly self-propagating cycle, employment practices liability suits lead to new legal precedents, new areas of exposure and ever-larger settlements and judgements that attract yet more plaintiffs' attorneys to the arena. Companies are even being sued more often by non-employee third parties, including customers and clients, who allege discrimination and harassment.

The term "Employment Practices Violation" includes:

  • Wrongful Termination
  • Harassment, including sexual harassment and hostile work environment discrimination
  • Retaliation, including lockouts, strikes, whistle blower actions
  • Employment-related misrepresentation(s) to an Employee or applicant for employment with the company
  • Employment related libel, slander, humiliation, defamation, invasion of privacy
  • Wrongful failure to promote
  • Wrongful deprivation of career opportunity or negligent Employee evaluation
  • Wrongful discipline
  • Failure to grant tenure
  • Failure to provide or enforce adequate or consistent corporate policies and procedures relating to any Employment practices Violation

Coverage Available:

Coverage is provided for the company, directors, officers, employees, seasonal employees, leased individuals and independent contractors. Coverage may be purchased included in a Directors & Officers Liability policy for a non-profit organization or a private company, or it may be purchased as a standalone product for a public entity.

In some instances, defense costs may be added outside the limit of liability. Coverage is available with either a "Duty to Defend" or a "Pay on Behalf of" language.

  • Claims include:
    • Oral or written complaint
    • Demand for Dollars
    • Administrative Proceedings
  • Punitive Damages Coverage, where insurable by law
  • Limits starting at $100,000; Retentions starting at $1,000
  • Third party coverage is also available
